Here is the link for it sniper! http://www.dol.gov/dol/topic/wages/overtimepay.htm

Overtime Pay

DOL Web Pages on This Topic
An employer who requires or permits an employee to work overtime is generally required to pay the employee premium pay for such overtime work. Employees covered by the Fair Labor Standards Act (FLSA) must receive overtime pay for hours worked in excess of 40 in a workweek of at least one and one-half times their regular rates of pay. The FLSA does not require overtime pay for work on Saturdays, Sundays, holidays, or regular days of rest.

Extra pay for working weekends or nights is a matter of agreement between the employer and the employee (or the employee's representative). The FLSA does not require extra pay for weekend or night work or double time pay.

I am with Ace, John, it makes me so furious that that company is doing that to her!!
I am about ready to say for sure..us 'little guys' ain't got a chance anymore..
especially us that have always choice to be independent and just work..oh
man! BTW, my hubby and I were talking today that the little guy can be a family
with a 100,000 income with 3-4 children..the way the economy is!
(I think I should have been a union leader...) :)
I see young families that are having to spend $250-350 a week just for groceries!
My gosh most women where I live don't even (BRING HOME) $350.00 a week! :(

John,

I think you might have misread that, my husband works for a major retailer, they pay $1 extra per hour when he works on Sunday. When I questioned the Corporate HR dept about it, I was told some states require it, so they pay it to all. I just read that link you provided and that is what it said. Also remeber .25 per hour shift premium?

Does you wife work for a company that does has multi-state locations, or is it local to your state only? If local, then state laws prevail, otherwise the federal laws prevail.

I just googled MN, and did a search for laws on overtime and this is what I found. http://www.doli.state.mn.us/overtime2.html

Hope this helps,

There is an exception were a employer has to pay overtime if you make under $450.00 a week called the Fair Labor Act! Buy you have to be doing a certain job for that! And she falls under one were they do not have to! manual laborers

U.S. Department of Labor
Employment Standards Administration
Wage and Hour Division
(November 2007)
Fact Sheet #17I: Blue-Collar Workers and the Part 541 Exemptions Under the Fair Labor Standards Act (FLSA)
The FLSA requires that most employees in the United States be paid at least the federal minimum wage for all hour worked and overtime pay at time and one-half the regular rate of pay for all hours worked over 40 in a workweek. However, Section 13(a)(1) of the FLSA provides an exemption from both minimum wage and overtime pay for employees employed as bona fide executive, administrative, professional and outside sales employees. Section 13(a)(1) and Section 13(a)(17) also exempts certain computer employees. To qualify for exemption, employees must meet certain tests regarding their job duties and be paid on a salary basis at not less than $455 per week.
Blue-Collar Workers
The exemptions provided by FLSA Section 13(a)(1) do not apply to manual laborers or other “blue-collar” workers who perform work involving repetitive operations with their hands, physical skill and energy. Such nonexempt “blue-collar” employees gain the skills and knowledge required for performance of their routine manual and physical work through apprenticeships and on-the-job training.
FLSA-covered, non-management employees in production, maintenance, construction and similar occupations such as carpenters, electricians, mechanics, plumbers, iron workers, craftsmen, operating engineers, longshoremen, construction workers and laborers are entitled to minimum wage and overtime premium pay under the FLSA, and are not exempt under Section 13(a)(1) of the FLSA nor the regulations at 29 CFR Part 541, no matter how highly paid they might be.

I think it is a shame that we, the hard working folk, get shafted the way we do. I have tried for years to get someone to report my companies policy on breaks, or lack of. But no one does!! You can bet that I will. I may not benefit, but others will.

I would call tomorrow, just for peace of mind!;)

See they do pay overtime during the week like the Fed says! Like one week Myra worked Mon threw fri and had 48 hours! She got paid 8 hours overtime! She also worked that Sat 8 hours and got Regular time! So what there doing sounds a awfull like what the Fed say that i printed in another thread there! So if you figure that the way the state says you showed me it is almost the same! State says 48 hours then overtime! Well she had a total w/sat of 56 hours! She got paid 48 hours reg and 8 hours overtime!
So that works the way the state says too!

no you misunderstand the laws a work week considered by the goverment is sunday to saturday that is a work week
any hours worked over 40 hours in this work week is considered overtime time and a half.

now some employers work saturday and sunday as thier regular shifts the employer does not have to pay time and a half for saturday and sunday because its part of thier regular shift and have monday and tuesdays off as thier weekend.

all hours worked over 40 hrs is overtime for a week sunday to saturday

Lanascountry
05-15-2008, 06:09 PM
I have to work (sometimes) Saturday and Sunday in retail as it is just part
of my job description. On Sundays, I make a little more pay even if I don't have
40 hours or ANY hours yet for the week. On Satuday..just a regular day, at my
store. (I have done it all my life, so I am used to it). Even when I was in nursing
the weekend was part of our regular schedule. It is often up to the employer
and job type. I hate to work for 6 hours with one small break though..It was
easier when I was young, now almost impossible, but I am doing it..:(
